AMENDMENT OF THE BYLAWS

OF DREAMS LANDING CONDOMINIUM

 

EXPLANATORY STATEMENT:  On or about June 26, 1975, the original Bylaws of Dreams Landing Condominium were recorded among the Land Records of Anne Arundel County, Maryland in Liber 2767, folio 45.  The Council of Owners of Dreams Landing Condominium, by the affirmative vote of Unit Owners having seventy-five percent (75%) or more of the voting interest of all Unit Owners of said Council of Owners at a meeting of said Council of Owners duly held for such purpose, now hereby amends its said Bylaws as hereinafter provided.

 

            NOW THEREFORE as of the 23rd day of September, 1989, the Bylaws of Dreams Landing Condominium are amended as follows:

 

Amendment No. 1

 

            Article V (captioned “Operation of the Condominium Regime”) of the above-described Bylaws of Dreams Landing Condominium is hereby amended to include a new Section 13 to be appended to the existing provisions of said article, said new Section 13 to read as follows:

 

                        Section 13.  Marina Operation.  The General Common Elements shall include the riparian rights of the Unit Owners including, without limitation, any and all pilings, wharfs, boat slips, docks, and other improvements in the Severn River (all of which are referred to in these Bylaws as “the Marina”).  Use of the Marina (including, without limitation, the individual boat slips thereof) shall be controlled by the Board of Directors as herein provided and all transfers of the right to use individual boat slips in the Marina shall be subject to such Rules and Regulations as the Board of Directors shall adopt with respect thereto.  All direct expenses of the operation, care, upkeep, maintenance, repair, improvement, and surveillance of the Marina shall be paid by means of rents, license fees or other assessments contracted for with, or made by the Board of Directors on, the users of the individual boat slips of the Marina.

 

Amendment No 2

 

                        Section 2 (captioned “Powers and Duties”) of Article III (captioned “Board of Directors”) of the above-described Bylaws of Dreams Landing Condominium is hereby amended to include a new subsection (o) to be appended to the existing provisions of said section, said new subsection (o) to read as follows:

 

                       [In addition to the duties imposed by these Bylaws or by any resolution of the Council of Owners that may hereafter be adopted, the Board of Directors shall have the power to, and be responsible for, the following:

                     …]

 

                     (o)          With respect to the Marina and riparian rights of the Unit Owners:

                    

                                   (1)        providing for the operation, care, upkeep, maintenance, repair, improvement, and surveillance of the Marina;

 

                                   (2)        controlling the use of the Marina (including, without limitation, the individual boat slips thereof) and, in connection therewith, entering into such renewable or nonrenewable leases, licenses, and permits for the occupancy of the individual boat slips for periods of one year or less as the Board of Directors shall deem appropriate;

 

                                   (3)        adopting Rules and Regulations for the use and operation of the Marina;

 

                                   (4)        determining and paying all direct expenses and costs of such operation, care, upkeep, maintenance, repair, improvement, and surveillance of the Marina;

 

                                   (5)        obtaining and collecting the monies required to pay all such direct expenses and costs by means of rents, license fees, or other assessments contracted for with, or made by the Board of Directors on, the users of the individual boat slips; and

 

                                   (6)        appointing members of a Marina Committee comprised of Owners who are users of the individual boat slips and delegating to that Marina Committee such duties with respect to the Marina as the Board of Directors shall deem appropriate.

 

                        The foregoing amendments shall take effect immediately.

CERTIFICATE OF APPROVAL

 

                        I HEREBY CERTIFY that on the 23rd day of September, 1989, I was the President of Dreams Landing Condominium and that, by virtue of said office, I was then the person specified by the Bylaws and the Board of Directors of said Condominium to count votes at all meetings of the Council of Owners of Dreams Landing Condominium.  I further certify that the foregoing Amendment of the Bylaws of Dreams Landing Condominium was on that date approved by the affirmative vote of Unit Owners of said Condominium having seventy five percent (75%) or more of the voting interest of all Unit Owners of said Council of Owners at a meeting of said Council of Owners duly held for such purpose.
